If you take no action

Civil sanctions

If the enforcement order is still unpaid after RTA restrictions are imposed, we can pursue the following civil actions to recover the outstanding fine.

Issue a property seizure order
This allows the Sheriff to enter your home or workplace and seize goods belonging to you to auction to pay the outstanding enforcement order.
Issue a garnishee order to your employer or bank
The garnishee order requires your employer or bank to deduct money from your wages or bank account to pay the outstanding enforcement order amount.
Issue an examination summons
We can issue you with a summons to attend court where an SDRO representative will examine your financial circumstances to determine any future action for you to pay the outstanding enforcement order amount.
Place a charge on land
The charge will prevent you from selling your property until you pay the outstanding enforcement order amount.

For each civil sanction an enforcement cost of $50 is added to the fine unless you were under 18 years of age at the time of the offence and the enforcement action was taken after 1 September 2004.

What options do you have if you receive a civil sanction?

If you have a civil sanction you have the following options:

  1. pay in full before the due date
  2. apply for time to pay by instalments
  3. request a review of the enforcement action if you believe it was issued in error or wish to have it heard before a court.
