RTA restrictions
If the enforcement order remains outstanding after the due date, we can direct the RTA to apply the following restrictions:
- Suspend your driver's licence
- This means you will not be able to drive or ride a motor vehicle.
- Cancel your vehicle registration
- This means you will not be able to drive your car on NSW roads. It also means your car insurance may not cover any damage to your vehicle.
- A customer business restriction
- This prevents you conducting business with the RTA.
- Cancel fleet registration of all or some vehicles, or apply business restriction
- If the fine was issued in a company's name, the fleet of vehicles may have all or one of its registrations cancelled or a business restriction will be applied which will prevent the company conducting any business with the RTA.
These restrictions may be applied for any type of outstanding fine - whether or not they are vehicle related.
When an RTA restriction is applied, there is an additional $40 enforcement cost added to the penalty amount and enforcement order costs already payable.
If you are under 18 years of age at the time of a non-traffic related offence and the enforcement order was issued after September 2004, we will not apply RTA restrictions.
If however, you were under 18 years of age at the time of a traffic related offence and the enforcement order was issued after September 2004, we will apply RTA restrictions but the additional $40 enforcement cost will not be charged.
What options do you have if you receive an RTA restriction?
If you have an RTA restriction you have the following options:
- pay in full before the due date
- apply for time to pay by instalments
- request a review of the enforcement action if you believe it was issued in error or wish to have it heard before a court.
