Can enforcement action be postponed or the enforcement order written off?
The Director of SDRO can postpone or write off your enforcement order if you can demonstrate serious and ongoing financial difficulties and health or domestic problems that affect your ability to pay.
The Director needs to be satisfied that any enforcement action is unlikely to result in the enforcement order being paid.
You need to provide evidence and supporting documentation showing you:
- cannot pay the enforcement order now and will be unable to pay the order in the future
- do not own any possessions that can be sold to pay your enforcement order
- cannot pay your fines off by completing a community service order.
The Director can postpone an enforcement order for five years and review your circumstances at the end of the period. If your circumstances remain unchanged, the amount owed will be written-off.
Note: if you receive any new enforcement orders after your application for postponement has been approved, the Director has the discretion to restart enforcement action on all the orders.
