SDRO Review Guidelines
If you believe there are special circumstances that apply to you, or you wish to seek leniency, you should request a review of the penalty.
If we receive your request for review before the due date of payment for the penalty or reminder notice, then we can consider your circumstances and you may not have to pay additional costs.
If another person was responsible for the vehicle at the time of the offence, you must provide a completed statutory declaration which allows us to identify the individual.
Read the SDRO Review Guidelines for the evidence that you require to successfully review a penalty notice. You can also read the Attorney General's Caution Guidelines and Internal Review Guidelines in relation to internal review of penalty notices.
To submit your request, please complete the request review of penalty notice and send it to us by post, fax or email with the documentary evidence attached. If you do not provide the necessary documentary evidence, SDRO will require it to be supplied within 14 days so that it can be considered. The review option is only available if a review has not already been conducted.
Providing a review has not already been conducted, we will place your penalty on hold while we conduct the review. You will receive written advice on the outcome of the review. If the penalty is to stand, you will receive a further penalty reminder notice to remind you of the options available to finalise the penalty.
Note: Please choose carefully. From 31 March 2010, the law requires that SDRO cease considering any request for review once a court election is received. If you wish to submit a request for review by SDRO, do not also request to have the matter decided in court or refer to court election in your letter. Also, if you send a request for review it is unlikely that time will permit you to request to have the matter decided in court if the outcome of your review is unfavourable. If you are unsure whether to request a review or choose to have the matter decided in court, the SDRO Review guidelines may assist you in your decision or you can contact us to discuss your matter.
