Nominate the person responsible
This information applies only to penalty notices and penalty reminder notices. If you have received an enforcement order, read information on requesting a review of an enforcement order.
For demerit points offences, companies and individuals are required by law to submit a correctly completed statutory declaration telling the SDRO the name and details of the person responsible for the offence.
If you were not the owner of the vehicle at the time, and have not yet updated your records at the NSW Roads and Maritime Services (RMS), you should do so now to prevent further fines being issued in your name for offences incurred in that vehicle. You will also need to provide the SDRO statutory declaration giving the details of the new owner.

Liability cannot be transferred for an 'on-the-spot' fine issued to an individual by a police officer, rail transit officer or other authorised government officer.
You must nominate the person responsible for the offence before the due date on the penalty reminder notice. If you fail to nominate another driver or owner within that time, a penalty notice for failing to nominate will be issued in your name.
Penalties in excess of $1000 for companies and for more than $500 per offence for individuals are issued for failing to nominate.
The RMS also deregisters the vehicles of repeat offenders.
Companies are encouraged to maintain vehicle logbooks to identify drivers of vehicles in which offences are committed.
If you have received a penalty notice for failing to nominate, you must now take one of the options outlined on the penalty notice or penalty reminder notice before the due date. After this time, the penalty will be enforced and further action and costs will apply.
